In this document you will find the general conditions of sale related to the purchase of activities from Backyard Svalbard AS. If you have any questions, please contact Backyard Svalbard via email or phone (information available at the end of this document).
Registration
Registration for activities must be done in direct contact with us by phone or email.
Payment Terms
For all activity bookings we will send you an invoice. The invoice must be paid within the payment deadline. If the payment deadline is not respected, Backyard Svalbard reserves the right to cancel the planned activity.
Cancellations
Any cancellation must be made directly to Backyard Svalbard via mail
Cancellation fees:
- Until 22 days before the activity the cancellation fee is 25% of the total activity price
- From 21 to 8 days before the activity the cancellation fee is 50% of the total activity price
- From 7 days and under before the activity the cancellation fee is 100% of the total activity price
Responsibility
Backyard Svalbard is responsible to implement the activities/program in a secure and safe way. We reserve the right to modify or cancel the planned route and activity if the original plan cannot be carried out safely.
Customer's obligations
Our customers are required to familiarize themselves with our conditions of sale before they buy the activity. Furthermore, the participants are obliged to follow any instructions given by the organizer and their tour guides, in addition to signing that they have read and understood the terms of participation before the start of the activity.
Customers Responsibilities
Our customers are responsible for assessing their physical and/or mental shape and ensuring they are able to take the tour they are booking. Customers are under no circumstances allowed to bring private weapons or pyrotechnic devices on the trips. Backyard Svalbard is not liable for accidents and injuries that are beyond its control.
Backyard Svalbard reserves the right to refuse admittance to a trip if the customer is a threat to safety, either for themselves or the other participants and the guide, or if the customer behaves so that he/she is of nuisance for the other participants. If the trip is delayed, changed or cancelled because one or more participants do not follow the operator’s instructions, they can be held financially responsible for any additional costs.
Insurance
Backyard Svalbard has a liability insurance through our insurance company, and we also set the necessary guarantees with the Governor of Svalbard. This includes expenses in connection with any rescue operations while on a tour led by Backyard Svalbard and our guides. Customers must have a private travel insurance.
Program Change / unforeseen events
Backyard Svalbard reserves the right to change departure times or cancel trips until the tour starts if there are too few participants. Likewise, Backyard Svalbard reserves the right to cancel trips until the tour starts due to weather conditions, force majeure or other events beyond the company’s control and which are an obstacle to safely carrying out the planned activity. Changes like this will not affect the activity price. If the weather conditions, third parties or other circumstances cause delays or make it impossible to carry out the event as agreed, Backyard Svalbard as the activity organizer and our guides as the activity runners cannot be made liable for compensation. The decision whether it is safe to carry out the program is made by the guide in discussion with the board in Backyard Svalbard. We will always strive to find alternative solutions within the financial framework, and to make such alternatives available to our customers at any given time.
If travel restrictions given by the Government of Svalbard occur, a full refund will be given to our customers.
